TERMS OF USE

The deal, in plain English.

No clause here exists to catch you out. If anything reads as unclear, email us and we will fix the wording rather than rely on it.

01

Who you are contracting with

These terms are between you and Govafy, Inc.(“we”, “us”). AgenSEO is a digital agency and brand of Govafy, Inc., not a separate legal entity or formal DBA. Govafy, Inc. is the contracting entity and the entity that receives payment. AgenSEO may appear as the customer-facing brand on proposals, checkout pages, invoices, receipts and correspondence.

Speculative previews

We sometimes build a working preview of a website for a company before that company has hired us. If you received a campaign link to one, this section applies to you.

A preview is our own work product, produced from publicly available information about your business. It carries a visible notice stating that it is a preview by Agenseo and is not your official website. A preview may be displayed in campaign spaces and is shown as your potential site before approval.

We use your company name and publicly observable facts to describe your business accurately. We claim no rights in your trademarks, logos or content, and we do not assert that you endorsed, approved or commissioned the preview. If you would rather we did not hold a preview for your company, email us and we will take it down. We will not ask you why.

A preview link stays live for 45 days. After that we may deactivate it. We keep the underlying work, so if you come back later we can usually restore it.

03

What we build

A Standard build is a responsive, search-ready marketing website with up to 50 pages: designed pages, working navigation, and the search and AI answer structure described on our Get Found page.

A Custom build can be a smaller specialty engagement, a site with more than 50 pages, or work involving APIs, logins, authentication, user roles, content management, client-managed blogs, databases, commerce, booking, portals or other application features. We define that work in a written scope and quote.

We include up to three meetings per build. After that we continue by email, which is usually faster. We are not trying to ration your access; we are telling you what the price covers.

04

Price and payment

Standard pricing is a setup fee of $3,499 plus $300 per page, counting every page including the home page, up to 50pages. Your quoted total and page count are shown on your proposal before you pay anything.

Custom work has Custom pricing. Its written quote states the approved scope, project total, payment schedule and delivery schedule before build work begins.

Payment is 50% on claiming and 50% on launch. The first 50% is what starts the work. The second 50% falls due when we deliver the finished site for your review.

Any time-limited offer, adjusted price or continuing incentive applies only when it is written in your private proposal. That proposal states the applicable amount, deadline and price afterward. Otherwise the quoted project price stays fixed. The site remains available through the preview period shown in your proposal.

Card payments are processed by Stripe. We never receive or store your card details. Prices are in US dollars and exclude any taxes that may apply to you.

05

Our 30-day completion guarantee*

We stand behind our Standard website work. A Standard site using Self-hosting, Essential or Growth will be launch-ready within 30 days* of kickoff, or you can ask for a full refund of your deposit.

For clarity:

  • The 30-day clock* starts at kickoff.
  • Launch-ready means ready for your review and approval. Your current site stays untouched until you approve the switch to the public live site.
  • If the site is not launch-ready within 30 days*, email us to request a refund. We will return your deposit in full.

Custom builds use a project-specific delivery schedule. We shape and agree that schedule around the scope so API integrations, secure logins, user roles, content management, publishing workflows, data, commerce and larger sites receive the architecture, implementation and testing they need.

06

What you own

When the project is paid in full, you own the website we built for you: the pages, the copy we wrote for you, the design as applied to your site, and the code in your repository. We will transfer the repository to you on request.

You keep everything you gave us. Your content, logos, trademarks and photographs remain yours throughout, and nothing here transfers them to us.

We keep the generic tools of our trade: our component libraries, build tooling, internal templates and know-how. We reuse those on other projects, and none of it contains your content or your branding.

Before full payment, the work remains ours. If a project is abandoned after the deposit, you do not receive the files, and we do not resell your specific site to anyone else.

We may show your finished site in our portfolio unless you ask us not to. Asking is enough; you do not need a reason.

07

Hosting and care plans

You may self-host with no monthly payment to Agenseo. We will set up the launch on an account you control and hand over owner access. Ongoing maintenance, updates and support are not included with self-hosting.

We recommend Vercel because it matches the technology used to build your site. For a site like this, Vercel typically costs about $20 a month, paid directly to Vercel. Usage-based charges can vary.

Care plans are optional and separate from the build price. Current plans are Essential at $89 a month and Growth at $149 a month.

Custom hosting, maintenance and support is available for projects outside those fixed plan scopes. We quote its architecture, maintenance, support cadence, billing and cancellation terms around the completed build.

You can choose Essential or Growth during kickoff or through its Get started link on the pricing page. Nothing is charged before you explicitly choose a plan and complete its Stripe checkout. Checkout starts a 30-day trial, and the first monthly invoice arrives 30 days after you subscribe. For a new website build, use the checkout at launch so the care-plan start stays aligned with delivery. Plans then renew monthly until you cancel.

Creator Care and Creator Back Office are optional monthly subscriptions chosen separately through the pricing page. Stripe charges the first monthly payment when you subscribe, and the plan starts after Stripe confirms that payment. These creator plans do not include a 30-day trial. They renew monthly until you cancel. Included work begins after confirmation and receipt of the storefront access and information needed to perform it.

You will never be enrolled in a fixed-price plan you did not explicitly choose. Manage or cancel your subscription through Stripe’s secure customer portal. Cancellation takes effect at the end of the current billing period. If you cannot access the portal, email hello@agenseo.ai. We will not ask you to call anyone or complete a retention process.

“Updates” means content and small design changes within the existing site: text, images, prices, adding or editing a page within your plan’s allowance. New functionality is a separate quote.

08

What we need from you

You confirm that content you give us is yours to use, that it does not infringe anyone else’s rights, and that any claims, certifications or credentials in it are accurate. This matters especially for government contracting content, where an inaccurate certification or contract vehicle can cause you real harm. We will not invent, infer or embellish any of it.

We may decline or stop work on content that is unlawful, deceptive or that we believe misrepresents your credentials. If that happens before we have done the work, we refund what you have paid.

09

Liability

We do our work carefully, and we still cannot promise that a website produces particular business results. Nobody honestly can. We do not guarantee search rankings, AI citations, traffic, leads or revenue. What we guarantee is the work itself and the delivery date in section 05.

To the extent the law allows, our total liability arising from a project is limited to the amount you paid us for that project. We are not liable for indirect or consequential losses such as lost profits or lost opportunities.

Nothing here limits liability that cannot be limited by law, including for fraud.

10

Changes and cancellation

Either of us can stop a project. If you cancel after paying the deposit but before we deliver, the deposit covers work already done and is not refundable, except under the 30-day guarantee* in section 05. If we cancel for any reason other than section 08, we refund your deposit in full.

We may update these terms. The version that applies to your project is the one published when you claimed. Material changes will be dated here.

11

Governing law

These terms are governed by the laws of the state in which Govafy, Inc. is incorporated, and the courts of that state have jurisdiction. If any part of these terms is unenforceable, the rest continues to apply.
